L’obiettivo è ricostruire, in modo documentato, il quadro degli atti amministrativi rilevanti e il comportamento tenuto dall’Amministrazione comunale nella fase successiva alla sentenza.
La posizione espressa dal Comune di Palermo
Con nota del Comune del 18/07/2022 , il SUAP di Palermo ha fornito riscontro a una richiesta di chiarimenti in merito al valore e alla portata dei contenuti dello studio di impatto economico, con specifico riferimento al conto economico semplificato.
In tale comunicazione, l’Amministrazione ha sostenuto che i costi di affitto indicati nello studio di impatto non costituirebbero elementi vincolanti ai fini del procedimento autorizzativo, ritenendo che essi attengano esclusivamente alla sfera dei rapporti privatistici tra operatori economici.
Secondo la posizione espressa dal Comune, la determinazione dei canoni di locazione sarebbe pertanto riconducibile alla libera contrattazione tra le parti e non inciderebbe sulle valutazioni amministrative poste a fondamento del rilascio dell’autorizzazione commerciale.
